Patent:
- Product that includes machines, electrical or electronic devices and tools;
Process that include method (steps) for producing a product;
Know-how, acts of using the process.
Petty Patent:
- Machines, electrical or electronic devices.
Applicant
Patent and Petty Patent:
Inventor or his assignee; assignee may be individual(s) or corporation(s).
Application and Filing
Patent and Petty Patent:
- Application shall be filed to Laotian Patent Office.
- Late documents can be submitted within 90 days from the filing date.
English or French version of specifications can be accepted at the filing time but the Laotian version should be submitted within 90 days from the filing date.
In case a Search Report is not attached with the application, the Registration Unit will coordinate with any patent examination body in a foreign country or any relevant International Searching Authority to conduct the search, but the entire expenditure will be covered by the applicant.
Convention Priority
Patent and Petty Patent:
- It is possible to claim priority from any earlier application for the same invention filed in any contracting state or international organization of Paris Convention if the Lao application is filed within 12 months from the filing date of the earlier foreign application.
Examination
Patent:
- It takes about 50 months from filing patent application to granting patent in Lao. Lao Patent Office shall rely on examination result of the foreign application for the same invention issued by Foreign Patent Offices. Patent applicant shall be required by Lao Patent Office to provide (i) a certified copy of results of search or examination carried out with respect to the foreign application of the same invention by the relevant Foreign Patent Office or (ii) a copy of the patent granted on the basis of the foreign application of the same invention or (iii) copy of final decision made by Court or relevant Organization on refusal of grant of patent for the same invention filed abroad.
Petty Patent:
- It takes about 12 months from filing petty patent application to granting petty patent in Lao.
Term of Protection
Patent:
- 20 years from the filing date, subject to payment of annuity fees.
Petty Patent:
- 07 years from the filing date,
subject to payment of annuity fees. Grace period of 6 months for late payment annuity is allowable.
