TRADEMARK PROTECTION IN LAOS





FILING REQUIREMENTS

For filing application

+ Information

  • Full name, address, and nationality of the applicant; 
  • Description of the trademark: meaning, colors claimed, translation or transliteration of characters into English if the mark contains foreign characters; 
  • Priority data for claiming priority right under the Paris Convention (if any), including application number, priority date, country of the priority application;
  • List of goods/services; 
  • International classification of goods and services, if known.

+ Documents

  • A notarized Power of Attorney from the Applicant. Legalization is not necessary (a fax copy is acceptable at filing provided that the original is submitted within 60 days from the filing date). The Power of Attorney should identify particular mark(s). One notarized Power of Attorney can be used for filing a single trademark or for several trademarks provided that all the identified marks are filed simultaneously at the same time;
  • 20 trademark specimens with the size of each not larger than 100mm x 100 mm and not smaller than 50mm x 50 mm (required at filling);
  • A certified copy of the priority application and the English translation thereof (if the application is not in English), or of the Exhibition Certificate (applicable where the Paris Convention Priority is claimedrequired at filing);
  • A certified copy of the Regulations governing the use of the mark (where the mark is collective mark – required at filling);
  • Documents evidencing the origin and prize(s) awarded to a particular product (if any.

For filing renewal

  • A notarized Power of Attorney from the trademark owner. Legalization is not necessary (a fax copy is acceptable at filing provided that the original is submitted within 60 days from the filing date); 
  • A copy of Certificate of Trademark Registration (required at filing); 
  • 20 specimens of the registered mark (required at filing).

For recordal of assignment

  • A notarized Power of Attorney from Assignee. Legalization is not necessary (required at filing; a fax copy is acceptable provided that the original is submitted within 60 days from the filing date); 
  • Original notarized/certified copy of the Assignment Agreement, including appendix or appendices (if any) plus a sworn English translation(s) if the documents are not in English (required at filing); 
  • Original Certificate of Trademark Registration (required at filing).

For recordal of license

  • A notarized Power of Attorney from Assignee. Legalization is not necessary (required at filing; a fax copy is acceptable provided that the original is submitted within 60 days from the filing date); 
  • Original notarized/certified copy of the License Agreement, including appendix or appendices (if any) plus a sworn English translation(s) if the documents are not in English (required at filing); 
  • Original Certificate of Trademark Registration (required at filing).

For recordal of change of name/address

  • A notarized Power of Attorney from the trademark owner. Legalization is not necessary (required at filing; a fax copy is acceptable provided that the original is submitted within 60 days from the filing date); 
  • Original notarized Declaration of Change of Name/Address or legal documents showing the change of name/address;
  • Original Certificate of Trademark Registration (required at filing).
